Terms, Conditions, & e-Sign Consent

Important: Please carefully review these (a) Pre-Qualification Request Terms and Conditions; and the (b) E-Sign Consent and Agreement, and retain a copy for your reference.

Pre-Qualification Request Terms and Conditions

  • You are providing written instruction under the Fair Credit Reporting Act for Main Street Motors and each of its finance sources to obtain and use information from your personal credit profile or other information from credit reporting agencies and to verify your information solely to evaluate your eligibility to pre-qualify for financing to purchase a Main Street Motors vehicle.
  • Any pre-qualification terms you receive are estimated, and valid on a 2021 or newer used Main Street Motors vehicle with the following mileage, based on the amount you requested (the “Parameters”):
    • If you requested more than $40,000, a vehicle with 25,000 miles or less
    • If you requested between $15,000 and $40,000, a vehicle with 40,000 miles or less
    • If you requested less than $15,000, a vehicle with 80,000 miles or less
  • For specific credit terms on a vehicle you select, you must submit a Main Street Motors credit application (“Application”) that will result in one or more inquiries that appear on your credit report, and may impact your credit score and rating.

  • In these Terms and Conditions, “you” and “your” mean the person(s) identified in this Request.
  • These Terms and Conditions apply to this Request and any subsequent Request(s).
  • Your Request is complete, accurate and subject to verification by each finance source.
  • A subsequent Request is required to change your Request information, the consideration of which depends on the finance source.
  • Any changes to your Request, credit report information, or a vehicle selection outside the Parameters could result in less favorable terms or a decline.
  • Main Street Motors may send your Request to one or more of its finance sources. They include:

    • American Credit Acceptance, LLC, 961 East Main St., Suite 200, Spartanburg, SC 29302

    • Ally Financial, Inc., P.O. Box 33414, Detroit, MI 48232
    • Exeter Finance Corp., 222 West Las Colinas Blvd., Suite 1800, Irving, TX 75039
    • Chase Auto Finance, 14800 Frye Road TX1-0011, Fort Worth, TX 76155
  • If Main Street Motors reviews and approves your Request, it may not be sent to other finance sources.
  • The following conditions and restrictions apply to any Main Street Motors pre-qualification:
    • Invalid for applicants under the age of 18 (or 19 in Alabama); and
    • Satisfaction of finance source conditions and documentation requirements.
  • You expressly consent that Main Street Motors and its finance sources may contact you (by calls, emails, text messages or other electronic messages) for any purpose related to your Request or Application by any means, including but not limited to the use of live or prerecorded / artificial voice messages, or text messages through the use of an automatic dialing device. Your express consent applies to any email addresses or telephone numbers you provide, including email addresses or cellular telephone numbers (a) that you and others may use and access; and (b) for which you may incur voice, data or other charges.
  • You agree that Main Street Motors and its finance sources may monitor and record telephone calls regarding your Request or Application.

State Specific Notices & Agreements

California Residents: A married applicant may apply for an individual account.

Married Wisconsin Residents: No provision of a marital property agreement, a unilateral settlement agreement under Wis. Stat. §766.59, or a court decree under Wis. Stat. §766.70 adversely affects the interest of the creditor unless the creditor, prior to the time the credit is granted, is furnished a copy of the agreement, statement or decree, or has actual knowledge of the adverse provision when the obligation is incurred.

Ohio Residents: The Ohio laws against discrimination require that all creditors make credit equally available to all creditworthy customers and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with this law.

New York Residents: A consumer credit report may be ordered in connection with this application, or subsequently with the update, renewal or extension of credit. Upon your request, you will be informed of whether or not a consumer credit report was ordered, and if it was, you will be given the name and address of the consumer reporting agency that furnished the report.

Rhode Island and Vermont Residents: A consumer credit report may be ordered in connection with this application, or subsequently for purposes of review or collection of the account, or other legitimate purposes associated with the account.

Maine Residents: The buyer has the freedom to choose the agent or insurer through which the buyer obtains any insurance required under a credit sale agreement. Obtaining insurance from a particular agent or broker does not affect the creditor’s decision to extend credit unless the coverage is inadequate under the terms of the credit sale agreement or otherwise not acceptable to the creditor.

Main Street Motors E-Sign Consent and Agreement

This Main Street Motors E-Sign Consent and Agreement (this “Consent”) applies to any pre-qualification request and/or credit application (each, an “Application”) you submit with Main Street Motors LLC.

In this Consent, the words “we,” “us,” and “our” refer to Main Street Motors LLC., and any of its affiliates, agents, independent contractors, designees, service providers, assignees, and prospective assignees and finance sources (each, a “Finance Source”).

Please read this document carefully and retain a copy for your reference.

Your Legal Rights Regarding Electronic Communications

Various laws require us to give you information in written paper form or to obtain your formal signed agreement or direction on certain matters. We may provide certain information to you electronically and obtain certain of your agreements electronically, if we first provide you this Consent and obtain your agreement to receive this Consent and other communications electronically and to enter into agreements electronically.

Types of Electronic Communications You May Receive

You agree and consent to receive electronically all communications, agreements, documents, notices, statements and disclosures (each a “Communication” and collectively the “Communications”) that we provide in connection with your Application(s) with Main Street Motors. Categories of Communications may include, but are not limited to, the following:

  • agreements and policies you agree and consent to (e.g., this Consent and any Application Terms and Conditions) and any updates to such agreements and policies;
  • any Application-related notices and disclosures required by law, such as credit report or credit score disclosures and notices, risk-based pricing notices, or adverse action notices; and
  • any other Application-related notices, disclosures, and information from us.

Electronic Agreements and Updates

We will not be obligated to provide any Communication to you in paper form unless you specifically request us to do so. We may send Communications to you in paper form because we are legally required to do so or because we determine in our sole discretion that you should receive the Communication in paper rather than electronic form.

Copies of Electronic Communications

You may retain a copy of any electronic Communication by using your print function or downloading and saving an electronic copy for your records. If, after you receive a Communication electronically, you would like a paper copy of a Communication previously provided to you, you may request a copy during the period we retain your documentation by contacting us at (800) 925-3612 or the applicable Finance Source(s) that provided you with the Communication. We will send your paper copy to you by U.S. mail. In order for us to send you a paper copy, you must have a current mailing address on file with us. We currently do not charge a fee to send you a paper copy of any electronic Communication, but reserve our ability to do so.

Withdrawal of Consent

You can withdraw this Consent by e-mailing msm@mainstreetmotors.org or calling (219)-476-0005 and asking that Communications be sent to you in paper or other non-electronic form. Your withdrawal of this Consent is effective only after we have had a reasonable period of time to act upon your withdrawal.

Your Contact Information and Ability to Access Communications

You agree to provide us with your current email address by which we can communicate with you electronically. You agree that the provision of your email address confirms and reasonably demonstrates that you can access any Communication in the electronic form that we will use to provide you with such Communication.

You must promptly notify us of any change to your email address by e-mailing msm@mainstreetmotors.org or visiting mainstreetnotors.org. If you give us an incorrect email address or fail to update or correct your email address, an electronic Communication will be deemed provided to you if we use the email address in our records for the electronic Communication.

Hardware and Software Requirements

In order to receive access and retain electronic Communications, you will need the following hardware and software:

  • a computer, mobile device, tablet or similar device with an internet connection;
  • a current web browser that supports HTTPS connectivity;
  • a current version of a software program that can open and display PDF files (such as an Adobe Acrobat reader);
  • a valid email address with email software to communicate with us electronically; and
  • an installed printer or sufficient storage space to save, store, print or otherwise retain electronic Communications.

By giving your consent, you are confirming that you have access to the necessary software and hardware, and can receive, open, print, download a copy or otherwise retain a copy of any electronic Communication for your records. You are advised to retain a copy of all electronic Communications as they may not be accessible online or in paper form at a later date.

Car Financing

Shopping for the best deal on an auto loan will generally have little to no impact on your credit. The benefit of shopping will far outweigh any impact on your credit.

You are completing a credit application to receive specific offer terms. This application will result in a hard inquiry, which may impact your credit score.

You only need to pre-qualify once. Once you’re pre-qualified, you can view your estimated financing terms for other cars as long as you’re within 30 days. Your pre-qualification terms remain valid for 30 days from the date of pre-qualification. Once you select the right car and are ready to purchase, you’ll need to send us your trade-in vin number and mileage so we can accurately give you a quiote.

Being pre-qualified enables you to view personalized, estimated terms on each car, assisting you in choosing the one that fits your budget. Once you decide on a car and are ready to submit a credit application, you can obtain precise offer terms for that specific vehicle. Until then, you can see the best estimates from our finance sources to aid in your shopping.
